Zoning Board of Adjustment

Appointed Officials, 3 year terms, expiring March.

If a town adopts a zoning ordinance, it must also create a Zoning Board of Adjustment (ZBA).  The role of the ZBA is to consider certain types of cases concerning the applicability of the zoning ordinance to particular parcels of land.  (RSA 674:33).

The Zoning Board of Adjustment is authorized to provide relief from the terms of the zoning ordinance or any decision of an administrative officer enforcing the zoning ordinance if appropriate conditions and standards are determined by the board.  The potential actions a ZBA can consider include:

  • Variances from the terms of the zoning ordinance (RSA 674:33, I (b) )
  • Special Exceptions that may be allowed on a case-by-case basis  (RSA 674:33, IV)
  • Appeals of Administrative Decisions  (RSA 676:5)
  • Equitable Waivers of Dimensional Requirements  (RSA 674:33-a)

Decisions of the ZBA are binding unless appealed by an affected party and overturned by the Superior Court.

The five voting members and four alternate members are appointed by the Board of Selectmen to staggered three-year terms of office.
